LayerOnline is dedicated to providing top quality service at a very affordable price. The conditions which follow are necessary to ensure that we may continue to provide the best possible service to all of our customers whilst at the same time satisfying our legal and ethical responsibilities.
Anytime unconditional money back guarantee
If you are not completely satisfied with our services anytime within your monthly service, you will be given a full refund. If you signed up for longer terms your refund will be prorated. Refund is not applicable to domain registration, SSL certificates and policy violations.
Lowest-price guarantee
If you find another webhost which offer the exact same or better set of features of what we offer for a lower price, we will price match and your hosting fee for the month and the previous month will be 100% credited to your account.
PageRanking
Our free PageRanking service is a courtesy service and does not guarantee Google will give higher PageRanking to your website. It also depends on other factors such as the quality of your site. Each customer can request for two PR links from our partners to any one of their new websites at a time for three months free. If you have many new websites, they will have to be in rotation or you can also buy more PR links and duration from us. The quantity of our PR links is limited and placement is not guaranteed. We reseve the right to decline your request for reasons such as, but not limited to, inventory full or poor quality of your website.
100% server and network uptime guarantee
If your hosting server at LayerOnline has an unexpected physical downtime or a network downtime, you wil receive the credit which is prorated for the amount of time the server is down, upto your monthly payment. Full credit will be given for the month if the server is down for more than 5 days. These guarantees don't apply to scheduled server maintenance and natural disasters. Server maintenance will be announced on the bulletin board of client area and it rarely requires the server to be rebooted. If the server goes offline due to maintenance which take longer than an hour, you will also get the prorated credit refund. To request for the credit, please contact us. Approval of the credit is at the discretion of LayerOnliner dependant upon justification provided. Third party monitoring service reports may not be used for justification due to a variety of factors including the monitor's network capacity/transit availability.
Bandwidth
For gold and platinum plans, there is no restriction on how you use the unmetered bandwidth.
Disk Space
for gold and platinum plans, you are entitled to use unlimited disk space for regular websites. Disk space is allocated 5GB at a time. You may at any time request for disk quota increase when your disk usage is near capacity. If you need more than 5GB of space to transfer your websites from another hosting company, let us know and we will allocate enough space, and we will even able to help you with the move. Regular websites do not include file-based hostings, such as image hosting, audio or video hosting, streaming, ftp repository, or any website which the primary purpose is to serve or stream files from disk, or simply for backup or file sharing purposes. These file-based sites require dedicated storage which is available with our semi-dedicated option. Our gold plan includes 5GB of dedicated storage and our platinum plan includes 10GB of dedicated storage. You are also able to increase the amount of dedicated storage anytime for a nominal fee.
Transfers
Our transfers team will make every effort to help you move your site to us. However, transfers are provided as a courtesy service, and we can not make guarantees regarding the availability, possibility, or time required to complete an account transfer. Each hosting company is configured differently, and some hosting platforms save data in an incompatible or proprietary format, which may make it extremely difficult if not impossible to migrate some or all account data. We will try our best, but in some cases we may be unable to assist you in a transfer of data from an old host.
Content
All services provided by LayerOnline may only be used for lawful purposes. The laws of Canada and the United States of America apply.
Legal adult content must be published in accordance of any applicable law or regulation.
Failure to respond to email from our abuse department within 48 hours may result in the suspension or termination of your services. All abuse issues must be dealt with via troubleticket/email and will have a response within 48 hours.
We reserve the right to refuse, cancel, or suspend service at our sole discretion. If in doubt regarding the acceptability of your site or service, please contact us at abuse@layeronline.com and we will be happy to assist you.
Resource Usage
User may not:
a) Run any scripts or programs which use more than 10% CPU for a prolonged period of time.
b) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
c) Run any software that interfaces with an IRC (Internet Relay Chat) network.
d) Run any gaming servers
Zero Tolerance Spam Policy
We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. "Safe lists" and "double opt-in" will be treated as spam. Any user who sends out spam will have their account terminated with or without notice. Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to SPAM sent via fax, email, instant messaging, or usenet/newsgroups. Any account which results in our IP space being blacklisted will be immediately suspended and/or terminated. LayerOnline reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is entirely at the discretion of LayerOnline.
Backups and Data Loss
Your use of the service is at your sole risk. LayerOnline is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on LayerOnline servers.
Cancellations
LayerOnline reserves the right to cancel the account at any time with or without notice. Any abuse of our staff in any medium or format will result in the suspension or termination of your services. Customers may cancel at any time via the client panel.
Disclaimer
LayerOnline shall not be responsible for any damages your business may suffer. LayerOnline makes no warranties of any kind, expressed or implied for services we provide. LayerOnline disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by LayerOnline and its employees.
Disclosure to law enforcement
LayerOnline may disclose any subscriber information to law enforcement agencies without further consent or notification to the subscriber upon lawful request from such agencies. We will cooperate fully with law enforcement agencies.
Changes to the TOS
LayerOnline reserves the right to revise its policies at any time without notice.
